Terms of Service

These Terms govern your use of the GSDAQ app and website and the purchase and use of credits. The app itself is licensed to you under Apple's standard Licensed Application End User License Agreement; where these Terms and that agreement overlap, that agreement controls the app license and these Terms control the service and credits. By using GSDAQ you agree to these Terms and to our Privacy Policy.

1. What GSDAQ is — and is not

GSDAQ provides information and education about the U.S. stock market: explanations of rules, indicators, news and the views of well-known investors, generated with the help of artificial intelligence. GSDAQ is not a broker-dealer, investment adviser, or financial planner, and nothing in the app is investment, tax, or legal advice or a recommendation to buy or sell any security. GSDAQ does not execute trades, hold funds or securities, or connect to brokerage accounts. You are solely responsible for your investment decisions. Markets involve risk, including the loss of principal; past performance does not predict future results.

2. Eligibility and accounts

You must be at least 13 years old to use GSDAQ, and at least 18 (or the age of majority where you live) to purchase credits. Sign in with Apple is optional; if you sign in, keep your Apple credentials secure and tell us if you suspect unauthorized use. You may delete your account at any time in Settings → Account; deletion is permanent and forfeits any remaining credits (see 5.6).

3. AI-generated content

Answers are produced by third-party language models chosen by us (free tier) or by you (paid models). They can be wrong, incomplete, out of date, or fabricated, including numbers and quotations. Verify anything you rely on. We do not review answers before they reach you. We may change, add, or remove models and providers at any time.

4. Free use

Free use is limited to a number of answers per device per day (currently 5) using the model we designate for the free tier. We may change the limit, the model, or the features included in free use.

5. Credits

  1. What credits are. Credits are a prepaid balance used to pay for answers beyond the free limit and for premium models. One credit equals one U.S. cent (US$0.01) of service value. Credits are a limited, revocable, non-transferable license to use the service; they are not money, deposits, gift cards, or property, have no cash value, cannot be exchanged for cash (except where refunds are required by law or by section 5.5), and cannot be transferred between accounts or sold.
  2. How credits are spent. Each answer deducts the metered cost of the model used, as billed to us by the provider, plus a service fee equal to 20% of the deducted amount. An estimate is shown before you choose a model and the actual deduction is shown on each answer. Estimates are not guarantees; long or complex questions cost more. Failed answers are not charged.
  3. Buying credits. Credits are sold in packages whose prices and quantities are displayed at the time of purchase. Larger packages may include bonus credits. Purchases made in the app are processed by Apple under Apple's terms; purchases made on our website are processed by Stripe. Prices may differ between channels. We may change package prices and bonuses at any time; changes do not affect credits already purchased.
  4. Expiration. Credits do not expire while your account or device balance exists. Unused credits are forfeited when you delete your account (5.6) or when we terminate your access for a violation of these Terms (9).
  5. Refunds. App Store purchases: refund requests are handled by Apple under the App Store's policies at reportaproblem.apple.com; we cannot issue App Store refunds ourselves. Website purchases: you may request a refund of the unused portion of a package within 14 days of purchase by emailing junethekim@gmail.com; credits already spent are not refundable. Bonus credits are removed proportionally on refund. If a purchase is refunded or charged back, the corresponding credits are removed from your balance, which may become negative until settled.
  6. Deletion. Deleting your account permanently removes any remaining credits. We warn you of the balance before deletion.
  7. Errors. If a system error grants or deducts credits incorrectly, we may correct the balance and will explain the correction on request.

6. Acceptable use

Do not use GSDAQ to: violate any law; attempt to extract, reverse-engineer, scrape, or resell the service, its data feeds, or model outputs at scale; circumvent free-use limits (for example by generating device identifiers); upload content you have no right to share or that contains other people's personal data; or interfere with the service's operation or security. We may rate-limit or suspend abusive use.

7. Your content and our content

You keep ownership of what you upload (questions, screenshots, holdings). You grant us the rights needed to process it to provide the service, including sending it to the AI providers described in the Privacy Policy. Answers generated for you may be used by you freely; we do not claim ownership of them, though similar answers may be generated for others. The app, its design, data compilations, lesson content and branding are ours or our licensors' and are protected by intellectual-property law. Market data and news headlines are provided by third parties under their terms and are for personal use only.

8. Third-party services

The service depends on Apple, Cloudflare, AI providers (OpenAI, Google, Anthropic, DeepSeek), market-data providers and, for web purchases, Stripe. We are not responsible for their availability or their terms, and outages on their side may interrupt the service.

9. Termination

You may stop using GSDAQ at any time and delete your account in the app. We may suspend or terminate access that violates these Terms or creates risk for us or other users, and may discontinue the service with reasonable notice; in that case we will refund unused credits purchased on our website and direct App Store purchasers to Apple.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANSWERS ARE CORRECT OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GSDAQ AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF US$50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the extent permitted.

12. Indemnity

You will defend and hold us harmless from claims arising from your violation of these Terms or of any law, or from content you upload.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing a claim, contact us at junethekim@gmail.com and we will try to resolve it informally within 30 days. Claims not resolved informally must be brought in the state or federal courts located in Los Angeles County, California, or in small-claims court where eligible, and you consent to that venue. Nothing here limits consumer rights that cannot be waived under the law of your residence.

14. Changes to these Terms

We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the app. Continued use after the effective date means you accept the changes; if you do not, stop using the service and, for unused website credits, request a refund under 5.5.

15. Apple-specific notice

These Terms are between you and June Kim only, not Apple. Apple has no obligation to furnish maintenance or support for the app and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the app license and may enforce them against you.
